Filing a Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our website by completing the following DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent. Upon receipt of the Notice as described below, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged content from the website.

  1. Identification of the copyrighted work claimed to have been infringed: Provide a description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Provide a description of the material that you claim is infringing and where it is located on our website. Please provide enough information to permit us to locate the material (e.g., a URL).
  3. Contact Information: Provide your mailing address, telephone number, and email address.
  4. Statement of Good Faith Belief: Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy and Authority: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.
  6. Physical or Electronic Signature: Provide your full legal name and an electronic or physical signature.

Counter-Notification Procedures

If you believe that material you posted on our website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our designated Copyright Agent by submitting the following information.

  • Identification of the Material: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., a URL).
  • Statement Under Penalty of Perjury: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact Information: Provide your name, address, telephone number, and email address.
  • Consent to Jurisdiction: Include a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Cherry Limeade may be found), and that you will accept service of process from the person who provided the original notification of the alleged infringement.
  • Physical or Electronic Signature: Provide your full legal name and an electronic or physical signature.

All notices and counter-notifications must be sent to our designated Copyright Agent via our contact page, specifying "DMCA Notice" or "DMCA Counter-Notification" in the subject line or message body.
